Terms of Processing Requests of Competent Authorities

These Terms of Processing Requests (the "Terms") set out the procedure by which NEX HOLDINGS LTD S.R.L. and its affiliates (collectively, "N.Exchange", "we", or "us") review and respond to official requests for information from competent authorities in connection with https://n.exchange/ (the "Website") and related services.
1. Scope and Competent Authorities
- We respond only to requests from competent authorities, meaning governmental bodies or officials lawfully authorized under applicable law to seek information for regulatory, law enforcement, or judicial purposes.
- Requests must comply with the laws of the jurisdiction in which N.Exchange operates. Where appropriate, requests may need to be submitted via established legal cooperation channels (e.g., Mutual Legal Assistance Treaties).
2. Submission Requirements
All requests must:
- Be made in English (or accompanied by a certified English translation).
- Be sent by email to [email protected] from an official email address clearly associated with the competent authority.
- Include the following information:
- The full legal name of the competent authority making the request;
- The name, title, and contact information (email, postal address, and phone number) of the responsible official;
- The legal basis for the request (e.g., subpoena, court order, statutory authority);
- A clear description of the information sought; and
- Transaction details, where relevant (e.g., wallet addresses, transaction hashes, amounts, dates, or other identifiers).
N.Exchange reserves the right to decline or request clarification if the submission does not meet these requirements or lacks a valid legal basis.
3. Processing Timeline
- Standard requests may take a minimum of fifteen (15) business days to process.
- Urgent requests (e.g., imminent threats to life or safety) should be clearly marked as such, and we will make best efforts to expedite review.
4. Categories of Information
Subject to applicable law and data availability, the information N.Exchange may provide includes:
- Account registration details (e.g., name, email, IP logs);
- Transaction history related to the Website;
- Wallet addresses and identifiers used in transactions;
- Other information lawfully collected and retained under N.Exchange's Terms of Service and Privacy Policy.
N.Exchange does not guarantee the existence of requested information.
5. Verification of Requests
- We may verify the authenticity of a request by contacting the issuing authority through alternative official channels.
- N.Exchange will not process requests that appear fraudulent, incomplete, or outside the scope of lawful authority.
6. Confidentiality and User Notification
- All correspondence relating to official requests is confidential and may be disclosed only to the extent required by law.
- N.Exchange may notify affected users of a request unless:
- Prohibited by law;
- Notification would compromise the investigation; or
- The request concerns an emergency situation.
7. Liability Disclaimer
N.Exchange will use best efforts to collect and provide accurate and complete information. However, we make no representations or warranties regarding the accuracy, adequacy, or completeness of data provided in response to a request. Information may be subject to technical or human limitations.
8. Data Retention
N.Exchange retains user and transaction data in accordance with applicable laws, including anti-money laundering (AML) and data protection requirements. Data that has been deleted or is outside retention timelines may not be retrievable.
